Birth injuries: When mistakes happen

Many pregnant mothers worry about labor and delivery and all of the possible variables. In the majority of cases, everything goes as planned and the result is a healthy new life. However, in some situations, a doctor error or a mistake by the labor and delivery staff can turn what should be a happy life milestone and cause for great celebration into a nightmare.

When a child is injured at birth, it often creates complications for the rest of the child's life. Fetal distress can mean that the baby is not getting enough oxygen, and if this is not properly monitored and handled by the labor and delivery staff, the baby may be born with a condition like cerebral palsy or other brain damage.

Improper or unnecessary use of forceps or vacuum extraction during delivery can also result in brain damage or other physical injuries. When a child is injured during birth, it can mean extended time in the neonatal intensive care unit and additional expenses for necessary physical therapy or follow-up visits.

Expecting mothers and their partners put their children's lives in the hands of professionals and expect the doctors and nurses to adequately monitor the birth and to handle any complications swiftly. Unfortunately, this is not always the case. If you believe your child suffered a birth injury because of negligence or malpractice on the part of the doctor or support staff, legal action may be an option.

These cases often hinge on whether it can be proven that the doctor purposefully did something wrong or did not act in accordance with the acceptable standard of care. At Walborsky & Bradley, we can help you understand what options may be available for your situation.
