In September 2015, the Environmental Protection Agency (EPA) announced that millions of Volkswagen (VW) and Audi “Clean Diesel” vehicles had an illegal device to cheat emissions tests.

The device was designed to sense when the vehicle was being tested and reduce emissions – but on the road, the vehicles emit up to 40X acceptable levels of nitrogen oxide (NOx).

The vehicles were marketed as clean, environmentally-friendly vehicles compared to cars with gasoline engines. Volkswagen charged buyers a significant premium for its models with the “Clean Diesel” engine. Not only did buyers pay a premium for the engine based upon Volkswagen’s fraud, they also paid significantly higher fuel costs as a result of the fraud. Finally, due to the fraud, the value of cars with falsely labeled “Clean Diesel” engines has significantly been impacted.
